Welcome to Virallized. These Terms of Service ("Terms") govern your access to and use of the Virallized website, platform, dashboard, services, products, content, and related features (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

For the purposes of these Terms, "Virallized", "we", "our", or "us" refers to VRLZD PTY LTD, an Australian company trading as Virallized, together with the operators, representatives, affiliates, contractors, related entities and service providers operating under the Virallized brand.

1. Eligibility

By using the Services, you confirm that:

  • you are at least 18 years old;
  • you have the authority to enter into these Terms;
  • all information you provide to us is accurate and current;
  • your use of the Services complies with all applicable laws and regulations.

    • We reserve the right to refuse access to the Services at our discretion.

    Virallized provides digital social media growth, audience development, engagement optimization, and marketing-related services designed to assist individuals, brands, creators, and businesses in growing their online presence.

    The Services may include:

  • growth campaigns;
  • audience targeting;
  • engagement optimization;
  • account management tools;
  • analytics;
  • dashboards;
  • strategy assistance;
  • and related digital marketing services.

    • Virallized may modify, suspend, replace, improve, or discontinue any part of the Services at any time without notice.

    3. Third-Party Platforms

    Virallized is an independent service provider and is not affiliated with, endorsed by, sponsored by, authorized by, or officially associated with Instagram, Meta, Facebook, TikTok, X (Twitter), Threads, or any other third-party platform.

    Your use of third-party platforms is governed by their own terms, policies, and guidelines.

    Virallized does not control third-party platforms and cannot guarantee:

  • uninterrupted access to platform features;
  • account performance;
  • algorithm stability;
  • platform availability;
  • or continued compatibility with any third-party platform.

    • Platform rules, policies, algorithms, APIs, enforcement systems, and operational requirements may change at any time and may impact the Services.

    4. User Responsibilities

    You are responsible for:

  • maintaining accurate account information;
  • maintaining access to any accounts connected to the Services;
  • complying with all applicable laws and platform rules;
  • ensuring that your account content and activity comply with platform policies;
  • cooperating with reasonable account verification or connectivity requirements;
  • ensuring that your payment information remains valid and up to date.

    • You agree not to:

  • use the Services unlawfully;
  • impersonate another person or entity;
  • interfere with or disrupt the Services;
  • abuse, harass, threaten, or intimidate our staff or representatives;
  • attempt to exploit, copy, reverse engineer, resell, or misuse the Services;
  • use the Services in connection with spam, fraud, deceptive practices, or illegal activity.

    • 5. Account Access & Security

    Certain Services may require account connectivity, authentication verification, or access permissions in order to function correctly.

    You acknowledge that:

  • internet-based services are never completely secure;
  • third-party platform security is outside of our control;
  • account interruptions, login challenges, verification requests, or temporary disconnections may occur from time to time.

    • Virallized takes reasonable measures to protect account-related information provided to us. However, we cannot guarantee absolute security.

    Text messages (SMS). If you tick the texting box when you provide a mobile number on the signup form, Virallized may send you automated text messages about your own campaign, such as a login confirmation or security code that Instagram is asking for, a password change notice, or a missing setting. Ticking the box is optional and is not a condition of purchase. Message frequency varies with your account's needs and is typically a few messages a month. Message and data rates may apply. Reply STOP to any message to opt out and HELP for help; you can also email support@virallized.com. Carriers are not liable for delayed or undelivered messages. We never send marketing texts. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.     6. Subscription Billing & Renewals

    Certain Services are provided on a subscription basis.

    By purchasing a subscription, you authorize Virallized and its payment providers to charge your selected payment method on a recurring basis until cancelled.

    Subscriptions renew automatically unless cancelled before the next billing date.

    Except as provided by the 7-day money-back guarantee in Section 7, no refunds will be issued for:

  • partially used billing periods;
  • elapsed subscription periods;
  • or renewals processed before cancellation.

    • 7. Refunds & Chargebacks

    Outside the 7-day guarantee window, refunds are discretionary and assessed on a case-by-case basis by our support team.

    Where a discretionary refund is approved, Virallized may provide:

  • a prorated refund;
  • account credit;
  • service extension;
  • or another reasonable commercial remedy.

    • 8. Service Availability & Interruptions

    Virallized does not guarantee uninterrupted availability of the Services.

    The Services may occasionally experience:

  • outages;
  • delays;
  • interruptions;
  • maintenance periods;
  • feature modifications;
  • connectivity issues;
  • or third-party platform disruptions.

    • 9. Results Disclaimer

    Virallized does not guarantee:

  • specific growth results;
  • follower increases;
  • engagement levels;
  • reach;
  • impressions;
  • monetization outcomes;
  • business revenue;
  • lead generation;
  • or commercial success.

    • Results may vary significantly depending on account quality, niche, audience behavior, market conditions, targeting selections, and third-party platform factors.

    10. Intellectual Property

    All content, branding, graphics, software, systems, designs, text, logos, dashboards, and materials made available through the Services are owned by or licensed to Virallized and are protected by applicable intellectual property laws.

    Clients retain ownership of their own social media accounts and content.

    11. Acceptable Use

    You agree not to use the Services:

  • in violation of any law or regulation;
  • to conduct fraud or deceptive conduct;
  • to harass or abuse others;
  • or to interfere with the operation of the Services.

    • 12. Disclaimer of Warranties

    To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis.

    Nothing in these Terms excludes any rights that cannot be excluded under Australian Consumer Law.

    13. Limitation of Liability

    To the maximum extent permitted by law, Virallized shall not be liable for indirect, consequential, or commercial losses arising from or related to the Services.

    14. Indemnity

    You agree to indemnify and hold harmless Virallized and its affiliates, contractors, representatives, service providers, and related parties from claims arising out of your use of the Services or breach of these Terms.

    15. Suspension & Termination

    Virallized may suspend, restrict, or terminate access to the Services at any time where these Terms are breached or where continued provision of Services becomes commercially impractical.

    16. Mediation & Dispute Resolution

    In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith mediation before commencing court proceedings.

    Any mediation shall take place in Victoria, Australia.

    17. Force Majeure

    Virallized shall not be liable for delays, interruptions, or failures caused by events beyond our reasonable control.

    18. No Partnership or Agency

    Nothing in these Terms creates a partnership, joint venture, employment relationship, fiduciary relationship, or agency relationship between you and Virallized.

    19. Changes to These Terms

    Virallized may update these Terms at any time. Updated Terms become effective upon publication on the Website.
